Terms and Conditions

APPLICABILITY OF TERMS AND CONDITIONS

(1) These General Terms and Conditions (GTC) apply to contracts for the temporary rental of holiday apartments for accommodation purposes, as well as all other services and deliveries provided to the guest by the provider. The provider’s services are exclusively based on these GTC.
(2) Subletting or transferring the rented holiday apartment to third parties or using it for purposes other than residential purposes is strictly prohibited.
(3) The guest's terms and conditions only apply if they have been agreed upon in advance. Deviations from these terms are only valid if expressly confirmed in writing by the provider.

BOOKING/BOOKING CONFIRMATION

Please direct any changes to your booking in writing to info@ebnerappartements.com or call us. If we can provide the desired holiday apartment for the requested period, you will receive written confirmation. The reservation becomes legally binding upon receipt of the booking confirmation and after payment of the deposit (see §3).

PAYMENT TERMS

  • A deposit of 20% of the total amount is due immediately upon booking confirmation and must be transferred to our account.

  • The remaining balance can be paid on-site.

  • For every reminder after a payment delay, a late fee of €20.00 will be charged to the customer. Additional costs incurred in connection with collection efforts will also be borne by the customer.

  • Any payment fees, especially for international bank transfers, must be fully covered by the customer. The amount must be credited to our account free of any charges.

  • Accepted payment methods: bank transfer, or on-site via cash or card.

CHECK-IN AND CHECK-OUT

  • Check-in: from 3:00 PM.
    If arriving after 8:00 PM, you will receive an access code for the apartment. Late arrivals must be communicated at least one day in advance. No claims for damages can be made if the apartment is exceptionally unavailable at 3:00 PM.

  • Check-out: by 10:00 AM.
    Late check-out may incur additional charges. The apartment must be left in a clean condition: dishes washed and stored, bins emptied, and the refrigerator cleared.

HOLIDAY APARTMENTS

  • The apartment is handed over in a clean and proper condition with complete inventory. Any defects or damages that arise during the rental period must be reported immediately.

  • The tenant is liable for damages caused to the property or inventory, including lost access keys (€30 replacement fee). Inventory must be handled with care and remain within the apartment. Moving furniture, especially beds, is prohibited.

  • The tenant is also liable for their co-travelers’ actions. Damages caused by force majeure are excluded from liability.

  • The contract may be terminated without notice if the apartment is used improperly (e.g., subletting, over-occupancy, disturbances, non-payment). Any resulting damages will be charged to the tenant. Prepaid rent remains with the provider.

  • In case of an insurance claim, the tenant must inform their liability insurance and provide the insurer’s name, address, and policy number to the landlord.

PET POLICY

  • Pets are not allowed in the holiday apartments unless expressly agreed upon in writing.

  • An additional charge will apply for pets. Unauthorized pets may result in a cleaning fee of up to €200 (net) plus €10 per night per pet.

OCCUPANCY

  • The apartment may only be used by the persons listed in the booking. Additional occupants will incur extra charges. In such cases, the provider reserves the right to terminate the rental agreement without notice.

  • Subletting or transferring the apartment to third parties is not permitted.

  • Acceptance of the GTC and house rules occurs upon payment. Violations may result in immediate termination without refund or compensation.

CANCELLATION POLICY

  • Up to 60 days before the arrival date: 20% of the agreed price.

  • Up to 30 days before the arrival date: 40% of the agreed price.

  • Up to 10 days before the arrival date: 60% of the agreed price.

  • 1 day before arrival or no-show: 80% of the agreed price.

Cancellation must be made in writing. Travel cancellation insurance is strongly recommended.

LANDLORD’S RIGHT OF WITHDRAWAL

In the event of cancellation due to force majeure or other unforeseeable circumstances (e.g., accidents, illness of the host), liability is limited to the refund of any payments made. No claims for damages, including travel or hotel costs, will be accepted. The landlord may terminate the contract without notice after the start of the rental if the tenant significantly breaches the terms or disturbs other guests despite prior warning.

LIABILITY OF THE LANDLORD

The landlord is liable for the proper provision of the rented property within the scope of due diligence. Liability for outages or disruptions in water or power supply or damages caused by force majeure is excluded.

WIFI USE

  • Guests may use the WLAN for internet access during their stay. Sharing access with third parties is prohibited.

  • The landlord does not guarantee availability, suitability, or reliability of the internet connection. The landlord may restrict access at any time.

  • Data transmitted via WLAN is unencrypted and may be intercepted by third parties. The use of WLAN is at the tenant’s own risk.

  • Tenants must comply with legal regulations and refrain from unlawful activities (e.g., illegal downloads, dissemination of inappropriate content). Any resulting claims or damages are the tenant's responsibility.

HOUSE RULES

  1. Quiet hours: 10:00 PM to 7:00 AM. TV and audio devices must be set to room volume.

  2. Windows and doors must be closed when leaving the apartment.

  3. Smoking is prohibited inside the apartment. Violations may result in a cleaning fee of up to €300 (net).

  4. Laundry washing/drying is not allowed in the apartments. Laundry facilities are available for €5 per load, including detergent.

  5. Parking is provided, but vehicles must not block garages or access roads.

  6. Decorations or alterations to the apartment are prohibited. Damages caused by such actions will be charged to the guest.

  7. The provider reserves the right to enter the apartment at any time, particularly in emergencies. Reasonable notice will be given where possible.

GUEST PASS

Upon completion of the accommodation contract, the Südtirol Alto Adige Guest Pass (consequently Guest Pass) will be issued to the guest, which according to the decision of the South Tyrolean regional government No. 732/2022, is valid for the entire duration of their stay as well as from 0:00 on the day of arrival unto 24:00 on the day of departure. 

The Guest Pass includes the use of all public transport within the “südtirolmobil” network area as well as additional services, which vary depending on the tourism organization. Detailed information can be found at: suedtirol-guestpass.info • The sole entity carrying the Guest Pass in South Tyrol is the Mobilitätskonsortium, appointed as the unified coordination point in accordance with the above decision of the South Tyrolean regional government by the Provincial Association of Tourism Organizations of South Tyrol on November 16, 2022.The details of the additional services associated with the Guest Pass and the conditions of use of the Guest Pass are communicated by the third party responsible for issuing and managing the Guest Pass. FINAL CLAUSE

No agreements beyond those specified in this contract exist. Verbal agreements are invalid. Acceptance of the GTC occurs with payment of the deposit. Issue date: March 2022.
